Orange API Specific Terms for the Product Catalog Management API Service

Note: The API is referred to as “THE API” in the present Terms.

1. API DESCRIPTION

Provides a standardized solution for submitting and consulting your incident tickets from Your own tools. This API is offering the same options as the ticketing menu of the customer portal.

2. CONTRACTUAL DOCUMENTS

Any defined terms not specifically defined in these Orange API Specific Terms for THE API will have the meaning attributed to them in section 1 of the Orange APIs General Terms.

THE API is only available to customers of Orange Wholesale International which have entered into a contract with Orange Wholesale International.

The Terms consist of (i) the applicable master services agreement (or similar document) entered into between You and Orange Wholesale International, (ii) these Orange API Specific Terms, and (iii) the Orange APIs General Terms, in descending order of precedence.

3. PRICE

Unless specifically stated otherwise in the applicable master services agreement (or similar document), THE API is provided by Orange for free, in view of such contract with Orange Wholesale International. New pricing may be introduced by Orange at any time, in accordance with the provisions of section 7 – FEES of the Orange APIs General Terms.

4. ACCESS AND USE OF THE API

4.1. Service Availability

THE API is available 24/7 outside scheduled works, updates and patches.
Orange will use reasonable efforts to provide THE API with high availability and response time. Orange will grant no guarantee or warranty with respect to THE API.
In addition, Orange informs you that THE API may be subject to suspension at any time for technical, operational, regulatory or other reasons (in particular but not limited to maintenance operation).

4.2. API consumer’s responsibilities

The use of the API by You will be Your responsibility.

In particular (without limitation), You will be liable for the use the API in accordance with the Terms
and laws and regulations applicable in the countries where the API is used.

You will not use the API for transmitting or receiving data or anything else that:
a)    is in violation of any applicable local, national, or international law or regulation;
b)    is defamatory, abusive, obscene, indecent, or harassing; or that threatens or encourages bodily harm, destruction of property, or infringement of the lawful rights of any party; or
c)    contains software viruses, Trojan horses, or any computer code, files, or programs designed to disrupt, destroy, invade, gain unauthorized access to, corrupt, observe, or modify without authorization, data, software, computing or network devices, or telecommunications equipment.

4.3. Data misuse


In the case You use any related Data in an unlawful or abusive manner or for any other purposes than as indicated in the master services agreement (or similar document) entered into between You and Orange Wholesale International, Orange is entitled to immediately withdraw the right to access the Data and to terminate these Specific Terms.

4.4. Data liability

While Orange makes every effort to ensure that the contents of THE API are accurate and up to date, Orange does not warrant that the Data is free from errors or omissions. Orange does not accept responsibility for any error or omission on THE API or information derived there from.

4.5. Limitations

The maximum number of calls to the API is limited to 2 requests per second, if your calls exceed this limit, Orange may suspend your access to the API until you bring the proof of implementing of a solution to respect this limit.

The Orange Developer platform on which THE API is made available has a service level objective (SLO) in terms of availability of 99,95%. There are no remedies in case of breach of this SLO.

4.6. Grant of Rights to Use.

Orange retains all right, title and interest in and to Intellectual Property Rights related to THE API and You are granted a limited right to use THE API under section 3 of the Orange APIs General Terms.

5. CONDITIONS OF CHANGES AND WITHDRAWAL OF THE API
The data and functions of THE API may change over time. It is your responsibility to ensure that calls or requests you make to THE API are compatible with our then-current API. Although we try to avoid making changes to THE API that are not backwards compatible, if any such changes become necessary, we will use reasonable efforts to let you know thirty (30) days prior to implementing those changes.
Notwithstanding section 9 - TERM AND TERMINATION of the Orange APIs General Terms, Orange will inform You of the termination of THE API one-month in advance of the date of the termination, without prejudice of any claim for damages.
